WESTMINSTER — A Cypress church youth group leader was sentenced today to 90 days in jail and three years formal probation for smoking marijuana and having sex with a 15-year-old girl.
Timothy Han, 21, of Fullerton, immediately began serving his jail term, said Farrah Emami, a spokeswoman for the Orange County District Attorney's office.
The sentence handed down by a Orange County Superior Court judge was part of a negotiated plea deal with prosecutors, Emami said.
Han pleaded guilty Oct. 8 to a felony count of unlawful sexual intercourse and a misdemeanor count of contributing to the delinquency of a minor. A felony count of oral copulation of a victim under 18 years old was dismissed.
Han was a youth group leader at Miracle Land Korean Baptist Church when he met the 15-year-old girl, Emami said. He smoked marijuana and had sex with her in the church parking lot on June 22, 2008, she said.
Han's attorney, Frederick Alschuler, maintained the sex was "consensual and there was no force involved,'' and that a psychological review showed his client is "not a sexual predator or sexually aberrant.''
"There's also no evidence in any way that he abused his position in the church,'' Alschuler said.
Han will do 45 days in jail and 45 days in a work-release program, Alschuler said.
Thirteen Han supporters, including two pastors and a minister, attended his sentencing hearing, Alschuler said.
